Waivo® Terms & Conditions for Furnished Finder Landlords

These terms and conditions apply to all Waivers with a Date of Purchase on or after May 1, 2025.

Congratulations, you have taken the first step to purchase a Waivo Damage Waiver (“Damage Protection Plan”) which is a service offered by Rental Protect, LLC, DBA Waivo® (“Waivo”) that you have purchased through Furnished Finder. You are a property owner, landlord, or property manager who lists property for rent via the Furnished Finder platform in all US Territories, and we will refer to you herein as the “Furnished Finder Landlord”, “Landlord” or “You.” To complete your purchase, you must review and accept the terms and conditions below.

In this document you will find the terms and conditions of Waivo Damage Waivers (each one a “Waiver”), under which you may choose to have Waivo reimburse you up to certain amounts for theft or damage to your rental property resulting from the acts of a tenant paying market rates (“Tenant”), or early termination by a Tenant if a Waiver type with early termination protection has been purchased:

1. Duties of the Landlord

Landlord’s timely and consistent satisfaction of these duties is a condition precedent to Landlord’s authority to use any Waiver or to use any form, logo, or insignia associated with Waivo or the Waiver, and is a condition precedent to Waivo’s duties as set forth herein the duties are as follows:

  1. Your decision to use a Waiver must be made before the Tenant enters the property. A Waiver must be purchased no later than 11:59pm the day the term of the lease begins.
  2. Landlord may only purchase a Waiver for a rental property with a unique listing on the Furnished Finder platform. The rental property address must exactly match the address on the unique listing and the lease, including a secondary number when applicable. The unique listing on the Furnished Finder platform must be active prior to the purchase of the Waiver.
  3. Waivers may only be used in connection with paying Tenants, and never for the occupancy of a Landlord or a non-paying guest.
  4. Each Waiver purchased must be accompanied by a lease signed by the Tenant(s) physically occupying the property. The lease must list all parties authorized to physically occupy the property during the rental period and be signed prior to the start of the lease term. Any modifications to a lease past 11:59pm the day the term of the lease begins must be accompanied by an original signed lease.
  5. Landlord must purchase an extension for the Waiver in the event the tenant’s rental period extends beyond the original lease terms. The Landlord must purchase the Waiver extension prior to the day the original lease term ends. The Waiver extension dates must match the dates of the lease and a signed lease amendment must be provided upon request.
  6. If the Landlord utilizes an intermediary or broker for the purpose of renting the property, there must be a signed lease between the Landlord and the intermediary and a signed lease between the intermediary and the Tenant. All rental details on the lease between the intermediary and the Tenant must exactly match the details on the lease between the intermediary and the Landlord. Failure to provide the required leases upon request or failure for the rental details to exactly match will result in an invalid Waiver purchase.
  7. No modifications to the Waiver purchased may be made after 11:59pm the day the term of the lease begins, including Waiver Limit and Waiver with or without early lease termination protection. Not all Waiver types include early lease termination protection.
  8. Landlord must provide the Waiver in its entirety without any alterations or edits, as provided in Addendum A, to the Tenant for each and every rental when the Waiver has been purchased.
  9. As outlined in Addendum D, each Waiver is for a one-time single continuous stay with a rental period selected by the Landlord. If a Tenant enters the property and then vacates for any reason, regardless of the duration of the occupancy, and returns to the rental property, that term is still considered a rental period. Each Waiver must be purchased for the exact lease term start and end date listed on lease signed by the tenant.
  10. A Landlord may request a full refund of a Waiver purchase but only if the refund request is in writing and is received by Furnished Finder prior to the day the Tenant’s lease term begins. Refund requests must be sent to Furnished Finder not Waivo.
  11. A Landlord may request a partial refund of a Waiver purchased but only if the refund request is in writing with proof the rental period was shortened. All refunds are subject the minimum Waiver fee in force when the Waiver was sold. Refund requests must be sent to Furnished Finder not to Waivo.
  12. In the event of a shortened rental period, the Landlord is responsible for cancelling any future scheduled payments. The modification must be made by the Landlord upon notice of modification from the tenant and cannot be shortened earlier than the date of notice.
  13. If there is damage or theft, the Landlord must submit a Damage Notice directly to Waivo, as outlined in Addendum B, within 7 business days after the Tenant has vacated the property. Time being of the essence for this purpose.
  14. Only if a Waiver with early termination protection has been purchased, if there is an early termination, the Landlord must submit an Early Termination Notice directly to Waivo, as outlined in Addendum C, within 3 business days after the Tenant has provided notice of early termination to the Landlord. Time being of essence for this purpose.
  15. Damage, theft, or early termination notices must be closed within 90 calendar days of submission unless an extension has been requested by the Landlord and approval has been received from Waivo staff. Damage, theft, or early termination notices will be closed by Waivo without payment if Waivo does not receive all documentation it requests within 90 calendar days.

2. Duties of Waivo to Landlord

  1. Waivo will assess the Damage or Early Termination Notice within two business days of receipt of the notice.
  2. If Waivo is responsible for the damage or loss then Waivo will reimburse the party who submitted the Notice via ACH, check, or other acceptable method.
  3. The Waiver Limit purchased for a one-time single continuous stay with a rental period selected by the Landlord, is the maximum amount that Waivo can be responsible to pay in connection with that rental period, including damage, theft, and/or early termination, even in the event that damage, theft, and early termination occur.
  4. Waivo is only responsible for damage, theft, or early lease termination for which a Waiver has been sold. Not all Waiver types include early termination protection and Waivo is only responsible for early lease termination for which the Waiver purchase includes early termination protection. Landlord must reimburse Waivo for any reimbursements made on an unsold Waiver. Waivo will not respond to damage or theft under $50 US dollars. If the damage or theft exceeds $50 US dollars then Waivo will reimburse for the repair or replacement of the damaged property, or the replacement of stolen property in the event the tenant listed on the Waiver purchase stole property during their rental period, up to the limit selected by the Landlord. In addition, for any theft a police report is required and must detail the stolen items, name the tenant on the Waiver purchase, and the date of incident must be within the rental period.  If Waivo reimburses for stolen items, then Waivo is entitled to any recovery of the items or their monetary value and reserves the right to pursue the Tenant to recover the stolen items or the monetary value of the stolen items to the fullest extent of the law.
  5. Waivo and its partner insurance companies are responsible for all regulatory filings, taxes and fees, as well as overall legal and regulatory compliance, associated with the Waivers.
  6. Waivo reserves the right, without notice, to block any person’s access to purchase a Waiver and may refuse to sell Waivers to any person, at any time and for any reason.

3. Exclusions

Waivo is not responsible for damages or theft resulting from the following:

  1. Acts of God
  2. Prior damage or normal wear and tear
  3. Cosmetic damage including but not limited to marring, scuffs, scratching, pitting, denting, or discoloration.
  4. Theft without a valid police report
  5. Mysterious disappearance or unexplained loss
  6. Loss of use of the rental property
  7. Rodent, termite, infestation, or wild animal
  8. Mold, mildew, fungi, or any microbial contamination
  9. Damage to a motorized vehicle
  10. Fine art, collectibles or antiques
  11. Odor remediation including replacement or repair of real property damaged due to odor
  12. Mechanical or electrical breakdown
  13. The Waiver will not reimburse for costs associated with laundering of linens, disposal of property, pet waste removal, pet or human hair removal, kitchenware cleaning, backup of sewers and drains, clogged plumbing, excess trash, spa/pool maintenance, landscaping, and maintenance.
  14. Waivo will not reimburse for damage resulting from improper installation, design flaws, or manufacturing flaws. Waivo reserves the right to determine if the damaged property was not able to withstand intended use.
  15. Waivo will not reimburse for losses resulting from early termination if the landlord did not purchase a Waiver in which early lease termination protection is included.
  16. Waivo will not reimburse for losses resulting from early termination if the landlord did not obtain a signed lease prior to the start of the lease term, if the signed lease does not exactly match Waiver purchase details, or if the lease does not include an early termination clause, defined start and end dates, and the monthly rental amount
  17. Waivo will not reimburse for losses resulting from early termination if the termination results from the following:
    1. Early termination of lease within 14 calendar days of the start of the lease term.
    2. The tenant has met the requirements of the early termination clause per the lease terms.
    3. Nonpayment of rent related to squatters, eviction, or early termination without notice.
    4. Tenant fails to provide written notice of termination to the Landlord or fails to submit a verified notice of early termination to Waivo if requested.
    5. Fault of the Landlord including but not limited to misrepresentation or non-disclosure of the rental property, habitability issues, sanitation and cleanliness, code violations, failure to make repairs, illegal entry or harassment, breach of lease terms, unsafe or criminal environment, unlawful leasing practices, discrimination, or retaliation.
    6. The rental property becomes uninhabitable.
    7. Eviction for any reason.
    8. Tenant dissatisfaction due to fault of the landlord.

4. Conditions of Waivo’s Duties

  1. Waivo will only pay for direct damage or theft of property owned or leased by the Landlord and located at the rental property. Waivo will not pay for theft or damage to property owned by the Tenant or the Tenant’s spouse, children or any other person the Tenant invited on to the rental property during their stay at the rental property.
  2. Waivo has the sole authority to determine the nature and extent of damages, necessary repairs, acceptability of early termination, and eligibility for the Waiver, and shall exercise that authority in a reasonable manner.
  3. Waivo will reimburse for assembly of replacement furniture up to a maximum amount of $50 US dollars.
  4. Waivo will only reimburse cleaning fees in direct relation to damage to real property and stain removal from upholstery, carpet, or rugs.
  5. Waivo will only reimburse the cost to replace linens damaged in the event a linen of any type is ripped, torn, burned, bleached, or dyed. Waivo will not reimburse the cost to repair or replace linens damaged due to stains.
  6. Waivo will reimburse only for the cost to replace a damaged item and will not provide reimbursement for the cost of additional items in a set.
  7. Waivo will only reimburse the cost to repair or replace appliances and electronics in the event the guest causes visible physical damage to the item.
  8. Waivo will reimburse for the cost to repair or replace real property in which damage was caused by a pet owned by the Tenant or Tenant’s guest. Reimbursement is subject to a $300 US dollars deductible and the maximum reimbursement amount is $1,000 US dollars.
  9. Waivo reimburses for labor charges directly associated with repairing or replacing property damaged by the Tenant. Waivo does not reimburse for general labor including but not limited to, drive time, administrative time, time inspecting damaged property, or time purchasing replacement property.
  10. Waivo reserves the right to determine if damages or early termination are eligible for reimbursement and at what value.
  11. Waivo will not pay for losses resulting from Early Lease Termination except to the extent the Landlord can demonstrate the actual loss of rental revenue that would have been enjoyed by the Landlord but for the early termination.
  12. Waivo will not pay for losses resulting from early termination in the event the tenant provides notice of termination on a date which is greater than the time period of the early termination clause in the signed lease.
  13. Waivo will not pay for losses resulting from early termination if a notice for lease termination is provided by the Tenant prior to the purchase of the Waiver or the purchase of a Waiver extension.
  14. Early lease termination reimbursement calculation will begin on the later of (i) the day after the tenant vacates the rental property, or (ii) the day after the final date through which rent was paid by the tenant. In the event you are unable to rebook the property, the total reimbursement shall not exceed the lesser of (a) 14 calendar days of prorated rent as specified in the lease, or (b) the Waiver Limit associated with the Waiver purchased by the Landlord, and shall be less any notice of early termination provided by the Tenant as specified in the lease.

5. No License or Other Transfer of Intellectual Property Rights

You acknowledge that by your access to and use of the Waiver, you are not receiving any license or other right to use the intellectual property, trade name, service marks, trademarks, trade dress, or logo owned by Furnished Finder or Waivo, except as may be strictly necessary for you to comply with the requirements set forth herein. You acknowledge that these Terms and Conditions are strictly confidential and may not be reproduced, disclosed, or used for any purpose other than facilitating Your relationship with Waivo.

6. Limitations

You acknowledge that Waivo is not under any circumstances liable for any lost profits, cost of re-procurement, loss of expected savings, or any consequential, incidental, special, indirect, exemplary, aggravated or punitive damages whatsoever arising out of or in any way related to the Waiver or the inability to use the Waivo products. Landlord acknowledges that Landlord has access to the Waiver exclusively through Furnished Finder, by virtue of Landlord’s acceptance of the Terms and Conditions set forth herein. You acknowledge that Waivo maintains insurance to the extent necessary to cover all obligations under the Waiver; but neither Furnished Finder nor Waivo is an insurance company, agent, or broker. The total aggregate liability of Waivo to Landlord, for all claims arising at law, in equity, or otherwise, including without limitation breach of contract or negligence, arising out of or related to these Terms and Conditions or any Waiver(s) shall not exceed the total amount Waivo has received in payment for the Waiver or Waivers at issue. In the event of suspected fraud by You, Waivo may terminate any Waiver immediately and is not obligated to reimburse for any damages regardless of the date of damage.

7. Governing Law; Jurisdiction and Venue

The laws of the State of Montana shall govern these Terms and Conditions as well as any Waiver(s), and You hereby irrevocably submit to the jurisdiction and venue of the state courts located in Montana, where any dispute shall be resolved if not first resolved through negotiation or mediation.

8. Miscellaneous

No aspect of the parties’ relationship shall be construed as a partnership, joint venture, employment, franchise, or agency relationship. The invalidity or unenforceability of any provision herein shall not affect the validity or enforceability of any other provision. In the event that any provision herein is determined invalid, unenforceable or otherwise illegal, such provision shall be deemed restated in accordance with applicable law, to reflect as nearly as possible the original intent of the parties, and the remainder of the terms shall be in full force and effect. A failure by either party to enforce the other’s strict performance will not constitute a waiver of its right to subsequently enforce the same or any other provision. This constitutes the entire agreement between parties relating to the subject matter and supersedes all prior oral or written communications and agreements. Waivo reserves the right to modify the content and terms unilaterally, immediately upon notice to the Landlord. All parties herby irrevocably waiver the right to a jury in any future dispute.

Waivo® Damage Waiver

Addendum A

If a Waivo® Damage Waiver has been purchased for your rental, then the following terms and conditions are now part of Your rental property lease agreement.

  1. AGREEMENT
    1. On behalf of ___________, the party authorized to rent the rental property and the owner of the rental property, Waivo has assumed the responsibility for damages as outlined below and up to $_______, the waiver limit for your stay at the rental property.
    2. Waivo is hereby responsible for direct damage to real or personal property of the rental property as a result of Your acts. Waivo will pay the lesser the cost of repairs or the cost to replace the property up to $_______. This Waiver does not negate your responsibilities as a Tenant for items outside of Waivo’s responsibilities.
    3. This is not an agreement to provide insurance. This is a damage waiver as part of Your rental property lease agreement.
  2. EXCLUSIONS
    1. This Waiver will not reimburse for theft or damages results from:
      1. Acts of God
      2. Prior damage or normal wear and tear
      3. Cosmetic damage including marring, scuffs, scratching, pitting, denting, or discoloration
      4. Mysterious disappearance or unexplained loss
      5. Loss of use of the rental property
      6. Rodent, termite, infestation, or wild animal
      7. Mold, mildew, fungi, or any microbial contamination
      8. Damage to a motorized vehicle
      9. Fine art, collectibles, or antiques
      10. Odor remediation including replacement or repair of real property damaged due to odor
      11. Mechanical or electrical breakdown
    2. This Waiver will not reimburse for damage or theft of property owned by You.
    3. This Waiver will not reimburse for costs associated with laundering of linens, disposal of property, pet waste removal, pet or human hair removal, kitchenware cleaning, backup of sewers and drains, clogged plumbing, excess trash, spa/pool maintenance, landscaping, and maintenance.
    4. This Waiver will not reimburse for losses resulting from improper installation, design flaws, or manufacturing flaws. Waivo reserves the right to determine if the damaged property was not able to withstand intended use.
  3. CONDITIONS
    1. Waivo has the sole authority to determine the nature and extent of damages, necessary repairs, and eligibility for the Waiver.
    2. Waivo reserves the right to determine if damage is eligible for reimbursement at actual cash value.
    3. This Waiver is only effective for a one-time single continuous stay. It takes effect when You occupy the property and terminates when You depart the same rental property.
    4. This Waiver is only effective if damage is reported to Waivo by the property manager or the owner of the rental property within 7 business days of Your departure from the rental property.
    5. Waivo will not respond to damage under $50 US dollars.
    6. This Waiver will only reimburse for cleaning fees in direct relation to damage to real property and stain removal from upholstery, carpet, or rugs.
    7. This Waiver will only reimburse the cost to replace linens in the event a linen of any type is ripped, torn, burned, bleached, or dyed. Waivo will not reimburse the cost to repair or replace linens damaged due to stains.
    8. This Waiver will only reimburse the cost to replace a damaged item and will not provide reimbursement for the cost of additional items in a set.
    9. This Waiver will only reimburse the cost to repair or replace appliances and electronics in the event of visible physical damage to the item.
    10. This Waiver will reimburse the cost to repair or replace real property in which damage was caused by a pet owned by You or Your guest. Reimbursement is subject to a $300 US dollar deductible and the maximum reimbursement amount is $1,000 US dollars.
    11. This Waiver will reimburse for labor charges directly associated with repairing or replacing damaged property. Waivo does not reimburse for general labor, including but not limited to, drive time, administrative time, time inspecting damaged property, or time purchasing replacement property.
    12. If there is a dispute related to these terms, mediation is required before any party may file litigation. In the event of litigation, all parties waive the right to a jury trial.
  4. DEFINITIONS
    • You, or Your, is the Tenant of the rental property and includes the Tenant’s spouse, children, and any other person the Tenant invited on to the rental property during the stay at the rental property.

Addendum B

Damage Notices

All Notices must be submitted by Landlord directly to Waivo at https://waivo.io/furnished-finder-notice/ and must include the information outlined below. Submissions cannot be made and will not be considered valid if they are communicated over the phone, email, or any other avenue that is not the submission link provided above.

Notices must be submitted within 7 business days after the Tenant has vacated the property.

The Landlord is required to file the Notice within 7 business days of departure and Landlord has 90 calendar days from the date of submission to provide additional information requested by Waivo including but not limited to make, brand, model of damaged items, pictures of each item of damaged property, police report for theft, invoices and receipts, and proof of cost to repair or replace damaged property.

If the additional information requested by Waivo is not received within 90 calendar days of the date of submission the Notice will be closed without payment unless written notice of extension is requested by the Landlord and approval has been received from Waivo staff.

Notice Requirements

  1. Landlord’s Full Name (host/owner/operator)
  2. Landlord’s Company Legal Name (if applicable)
  3. Primary Tenant’s Full Name
  4. Tenant Check-in and Check-out Date in Which Damage Occurred
  5. Full Address of Location of Damaged Property
  6. Detailed Description of Damage
  7. Make, Brand, and or Model of Damaged Items
  8. Estimated Cost of Repair or Replacement
  9. Pictures of Each Item of Damaged Property
  10. Police Report for Theft
  11. Proof of Waiver
  12. Proof of Signed Lease
  13. Proof of Online Listing on Furnished Finder
  14. Proof of Cost to Repair or Replace Damage Property

Addendum C

Early Termination Notices

The following only applies for Waivers purchased in which early lease termination protection is included. Not all Waiver types include early lease termination protection.

All Early Termination Notices must be submitted by the Landlord directly to Waivo at https://waivo.io/furnished-finder-notice/ and must include the information outlined below. Submissions cannot be made and will not be considered valid if they are communicated over the phone, email, or any other avenue that is not the submission link provided above.

Notices must be submitted to Waivo within 3 business days after the Tenant has provided notice to the Landlord of early termination.

The Landlord has 90 calendar days from the date of submission to provide additional information requested by Waivo. If the additional information requested by Waivo is not received within 90 calendar days of the date of submission the Notice will be closed without payment unless written notice of extension is received by Waivo.

Notice Requirements

  1. Landlord’s Full Name (host/owner/operator)
  2. Landlord’s Company Legal Name (if applicable)
  3. Primary Tenant’s Full Name
  4. Tenant Check-in and Check-out Date per Lease Terms
  5. Full Address of Proper
  6. Signed Lease and Lease Amendments if applicable
  7. Tenant’s Date of Early Termination and Date Notice Provided by Tenant
  8. Date Rent Paid Through by Tenant and Final Rent Payment Documentation
  9. Proof of Total Payment Received by Landlord for Lease Period (upon request)
  10. Estimated Lost Revenue Excluding Advance Rents Not Reimbursed
  11. Detailed Description of Reason for Early Termination
  12. Timestamped Written Termination Notice from Tenant Specifying Termination Date and Reason for Termination and Records of Correspondence with Tenant Requesting Early Termination
  13. Tenant’s Employment Contract Change Notice (if applicable)
  14. Proof of Online Listing on Furnished Finder
  15. Waivo may request a verified notice of early termination from the Tenant

Lease Requirements

A valid and signed lease agreement between the Landlord and Tenant must accompany the Waiver for the Waiver to be deemed valid.

The Lease must include all of the following:

  1. Signatures of the Landlord and Tenant(s) physically occupying the property
  2.  Lease terms must include a start and end date
  3. Signed lease amendment if rental period extended beyond original lease term
  4. Lease terms must include an early termination clause

Addendum D

Waiver Purchase Requirements

All Waivers must be purchased through the Furnished Finder platform.

A Waiver must be purchased for the entirety of the rental period on the signed lease. A Waiver must be purchased no later than 11:59pm the day the lease term begins.

Landlord may not modify the Waiver Limit purchased or Waiver type after 11:59pm the day the lease term begins. Not all Waiver types include early lease termination protection.

Each Waiver is valid for a single, one-time continuous stay of a tenant. The rental period selected by the Landlord must encompass the entirety of the time the tenant occupies the property. The rental period selected by the Landlord must exactly match the signed lease terms. Waivo reserves the right to request proof of lease at any time. Waivers can only be purchased by or for paying renters and not for the owner of the rental property or their non-paying guest.

If a tenant enters the property and then vacates for any reason, regardless of the duration of occupancy, the term is still considered a rental period. In the event a tenant occupies the rental property for multiple consecutive rental periods, a Waiver must be purchased for the entirety of the time the tenant occupies the rental property. 

Waiver extensions must be made prior to the end of the original lease term and extension purchase dates must exactly match the lease term on the signed lease amendment. Waivo reserves the right to request a copy of the signed lease amendment at any time and failure to provide a copy of the signed lease amendment will results in an invalid Waiver.

Waivers purchased after 11:59pm the day the lease term begins, and Waivers purchased that do not match the lease terms for the entirety of the time the tenant occupies the rental property are deemed invalid. In such cases, Waivo is not responsible for any damage, theft, or early lease termination that may occur during the rental period.

Waiver purchase must include the following information in alignment with the lease terms:

  1. Tenant(s) Full Name(s) whom is physically occupying the property
  2. Lease start and end date
  3. Full Address of Rental Property including unit number when applicable
  4. Landlord Full Name
  5. Waiver Limit

Addendum D Continued

Waiver Purchase Requirements

Cancellations
Landlord is responsible to cancel a Waiver purchase prior to the day the lease term begins in the event a tenant has cancelled their lease.

Modifications
Landlord is responsible to modify a Waiver purchase in the event a tenant’s rental period changes from the original lease terms.

Landlord may not modify the Waiver purchased after 11:59pm the day the lease term begins.

Waiver extensions must be made prior to the end of the original lease term and extension purchase dates must exactly match the lease term on the signed lease amendment. Waivo reserves the right to request a copy of the signed lease amendment at any time and failure to provide a copy of the signed lease amendment will result in an invalid Waiver.

In the event of a shortened rental period, the Landlord is responsible for cancelling any future scheduled payments. The modification must be made by the Landlord upon notice of modification from the tenant and cannot be shortened earlier than the date of notice.

Refunds, Shortened Stays, and Extensions
Refund requests must be submitted to Furnished Finder and cannot be submitted to Waivo.

Landlord may request a full refund of a Waiver purchase but only if the refund request is in writing and is received by Furnished Finder prior to the day the tenant’s lease term begins.

Upon request of the landlord, a refund will also be issued in the event a Waiver is deemed invalid because the Waiver was purchased after 11:59pm the day the tenant’s lease term begins or is deemed invalid because the Waiver does not match the dates on the lease for the entirety of the time the tenant occupies the rental property.

Landlord may request a partial refund of a Waiver purchased but only if the refund request is in writing with proof the rental period was shortened and an equivalent refund was provided to the tenant by the Landlord. All refunds are subject to a minimum Waiver fee in force when the Waiver was sold, which is always nonrefundable, and the rental period cannot be shortened to a check-out date earlier than the date notice was provided by the Landlord to Furnished Finder.

In the event a tenant extends a rental period at the rental property beyond the initial lease terms selected by the Landlord, the Landlord must purchase an extension of the Waiver via the Furnished Finder platform prior to the end of the original lease terms. The extension must encompass the entirety of the time the tenant occupies the rental property.
